Booking Conditions:
1. General
(a) The following booking conditions and information form the basis of your contract with All of America Ltd and all bookings are made subject to acceptance of these terms and conditions.
These Conditions and any agreement to which they apply are governed in all respects by English law.
We both agree that any dispute, claim or other matter which arises between us out of or in connection with your contract or booking will be dealt with by the Courts of
England and Wales only. No variation of these terms shall be effective unless made in writing and signed by both parties.
We both agree that you have not relied on and you are not entitled to rely on any warranty or representation except as expressly stated or referred to in these terms
and these terms set out the entire agreement and understanding between the parties in connection with matters described herein.
If any exclusion(s) or limitation(s) contained in these terms is found, in whole or part, to be unlawful, void or for any other reason unenforceable for any purpose(s),
that exclusion(s) or limitation(s) or the part(s) in question shall be deemed severable and omitted from these terms for that purpose / those purposes.
Such omission shall not affect the validity, effectiveness or enforceability of the other provisions of these terms.
Headings used in these terms and conditions are for convenience only and shall not affect their interpretation.
The parties hereby exclude any rights that any other party may have in relation to this Agreement under the Contract (Rights of Third Parties) Act 1999.
(b) All prices are in Pounds Sterling.
(c) It is the responsibility of the travel agent and client to check the accuracy of the information booked in confirmation invoices received. Any errors must be reported to us within seven days from the date printed on the confirmation invoice or before the client departure date, whichever is earlier.
2. Payment Terms
(a) If you make a booking more than 8 weeks before the departure date of travel you will have to pay a non-refundable deposit equal to 15% of the total gross invoice cost rounded up to the nearest pound or £100.00, whichever is the greater. This deposit is per total booking, not per person. Certain holiday components may require a higher deposit, but this will be informed to you before you commit yourself to the booking.
(b) Final payment is due eight weeks before your departure date. Late payment may result in the cancellation of services. No services will be provided unless payment is received for the full amount shown on the invoice by the due date
For bookings made more than eight weeks before the date of the first service, a non refundable deposit equal of 15% of the gross invoice cost rounded up to the nearest pound or £100.00, whichever is the greater.
All sevices confirmed on All Of America's invoice are considered definite and final.
3. Cancellations & Amendments
All cancellations and amendments unless a special cancellation policy is stated on our invoice, will be subject to the following cancellation and amendment policy.
Notice of any cancellation or amendment must be made either through our on-line booking system or in writing and will be actioned upon receipt.
41+ days prior to the date of the first service: loss of deposit.
40-15 days prior to the date of the first service: 50% of total gross invoice cost (or deposit, whichever is the greater)
If cancelled within 14 days prior to the date of the first service the full gross invoice cost will be forfeit.
4. Amendments:
Changes in departure date, hotel, or number of nights that doesn't reduce the total holiday cost will incur a fee of between £15.00 per room or unit of service. Changes which reduce the total holiday cost will be treated as cancellations and will incur cancellation charges as previously stated. Booked services after commencement of travel will not be refunded by All Of America under any circumstances irrespective of information to the contrary by hotel staff etc.
5. Changes By The Company:
On occasions it may be necessary to amend certain arrangements of your holiday, which we reserve the right to do so at any time. If a major change occurs we will inform you, or your agent as soon as possible. A major change is one that involves a change of resort area, or a lower class of accommodation. In such instances you can a) accept the new arrangements b) purchase another available All Of America service or c) cancel your service free of charge with no further claims for compensation. If a or b we will pay compensation as follows based on the period before commencement of the first service within major change notified to you or your travel agent.

56-28 days £10 per person
27-15 days £20 per person
14- 0 days £30 per person
Once the change is confirmed and accepted no further claims for compensation or additional expenses will be accepted. No compensation will be paid or liability accepted if a change is made due to force majeure; risk/threat of war, industrial disputes, riots, civil strife, terrorist activity, natural/nuclear disasters, fire or adverse weather conditions or similar events beyond our control.
All Of America reserves the right due to operational reasons to substitute hotels of equal or superior quality when necessary.
6. Prices and Surcharges:
All prices shown on our invoice are gross including taxes (unless stated to the contrary against any individual service). All prices are in £'s and include all taxes known at the date of invoice. Once an invoice has been paid in full the cost of the service is guaranteed and will not be subject to surcharges due to currency fluctuations or tax increases.
7. What to do if you have a problem or complaint:
If you have complaint about any of our services or facilities which make up your holiday you have a legal duty to inform the actual supplier of those services or facilities as soon as possible. If you do not do this it may affect your legal rights and may reduce or even extinguish any compensation which you might otherwise be entitled to receive.
If you have a serious problem which cannot be resolved you should contact the offices of All Of America / All Of Asia here in the UK in normal working hours. If your problem is still not resolved you should contact us in writing within 28 days of the last service provided by us. If you fail to follow this procedure our ability to investigate your complaint may be seriously hampered and we reserve the right to reject without liability your complaint.
8. Resort Fees
Some hotels charge additional 'resort fees' directly to clients that are not included in our rates. These charges are levied for various facilities e.g local calls, daily newspapers, use of sport facilities etc. These charges are beyond the control of All of America/All of Asia and cannot be pre paid. Please call Reservations on 01233 660553 or email us res@allofamerica.co.uk to check if the hotel levies such charges before making your reservation. All resort fees are subject to change without notice.
